A possession order granted by the court may be made as an absolute order or suspended on terms. For example, a landlord’s allegations of anti-social behaviour (Ground 14) may be found to be proven and the tenant may have produced no evidence to suggest that their conduct has or will change.
In that situation the court may decide to make an absolute order. By contrast, an application made due to breach of contract on the basis of the tenant failing pay rent (say Ground 10) may be granted as a suspended order, if the tenant has shown that since the application was made, they have commenced making regular payments towards the arrears.
