Subject: Do I need a solicitor?

I have one flat that I rent out. I have a new tenant who has been in the flat for two months and he's giving me problems with payment, being late, not answering phone calls. Do I need to get a solicitor involved or are there any commercial companies that I could use to ensure that he pays on time?

Landlord Action can deal with problem tenants, but it sounds like you might just need to have a friendly chat with him, there could be a reasonable excuse that you can live with. If you start going to a solicitor or soemone like landlord action its going to cost you money you might not need to spend.

Go and have a chat....

I now collect two months rent as a deposit in case of such problems, if he has broken the terms of his agreement you could give him 2 months notice???

Do this:

1. Send the tenant a letter by recorded del. explaining what he/she has done wrong and asking them to rectify and pay on time, otherwise will have to pass to a solicitor and he will then incur further costs.

In my experience, this usually sorts out sloppy payers. If the tenants is worse, then do as the other posters to the forum suggest and get other involved (at cost to you).

I always try to figure out if I have a tenant who "cannot manage their money properly but is basically honest, and will pay once we've helped them out a bit" or a tenant who "won't pay even though they can afford it". If you have the latter then get rid asap.

Thanks everyone for your help. I took your advice bigman and it seems to have worked. The guy was just having money problems and he rang me and explained. Since then he's been fine and appears to be looking after the property. Again, thanks everyone you've probably saved me an awful lot of time, effort and money.
