Hi what is the next stage. I have issued a section 21 to the tenants in my house. They have now been given another 2 months to stay which takes them to the 10th April. What are the chances of me getting any rent due to be paid soon as they have also stopped the SO. They said they have no choice as they cannot afford to buy in the area they have a 2 month old baby. I myself returned from abroad expecting to get my property back so that I could live in it and then sell it. In the meantime I am sleeping with a friend sharing a bed which I consider not to be healthy as she has her own children living in a 2 bedroomed house. I dont see where the justice comes in this country. Where does this all leave me apart from suffering from stress and vertigo. Any suggestions!!!

Firstly:-

When you state she has 'been given a another 2 months to stay' Who allowed them to stay?

Is there an agent involved?

In respect to the rental arrears, have they only occured after the serving of the section 21 notice?

When they state that they have stopped the s/o as they cannot afford to buy in the area. They must of been saving some sort of money to buy in the first place. We feel that this is a 'ruse' for them to be rehoused by the council. Irespective of them not being able to afford a place to 'buy' they could locate another property to 'rent'

You should pursue the arrears by writing to them, and keeeping copies of all letters. Once they are 2 months in arrears is to serve a section 8 notice + a section 21 (again) to bring tenancy to end. The section 8 notice is the pre-requiste notice required prior to any court action. When you file papers in court, annex the contract, letters you have sent to them pursuing rental.

Include in these letters that by them not paying (or making any attempts to pay) the rental, they are in effect making themselves intentially homeless. This will proove invaluable to you, if the council are involved. As the council will be under no obligation to house someone who has made themselves intentially homeless.
