I've had the same tenant in my property for the last 3 and a half years and shes leaving. Shes just told me that shes planning to sue me because I haven't placed her deposit in one of the government schemes.

I thought they only applied to new tenancies after 2008. Can someone please advise me if shes got a case?

If you have an assured shorthold tenancy that commenced after 6th April 2007 your landlord is legally responsible for protecting your deposit.

Your landlord or landlord's agent is required to place your deposit in a statutory tenancy deposit scheme within 14 days of receiving it.

As she has been there three years, did you renew the contract after April 2007, if so then you were liable to protect the same and give her notifiation of the same.
