Has anyone any views on whether it is better to run an existing tenancy on as a Staturoty Periodic Tenancy or a new Tenancy Agreement. I have one Tenant who has specifically asked for a new 6 month Tenancy. The only benefit from a new Tenancy would be I know that I have a tenant for another 6 months.

My advice is to always insist they sign another AST for 6 or 12 mths. It is clearer and easier for you both to understand and it does guarantee your tenant for a longer period generally. Also you can use each renewal as an opportunity to review the rent. If I have a good tenant I 'sell' them on the idea of a 12mth agreement on renewal so that their rent is guaranteed not to rise for the next 12mths.

Also ensure you get the tenant to acknowledge you have served notice omn them before they get the keys. This gives you a lot less hassle if you do need to start eviction proceedings in the future.

Join RLA www.rla.org.uk as they have lots of advice and even free tenancy s/ware you can use to generate agreements and notices etc. I use it and it's good!

the tenant has only to give you one months notice to quit you however still have to give two months notice, whereas an AST has the notice period of 2 months from either side. Always, issue a new Section 21(b) notice before filling out the AST.

I'm not sure the gameplayer is quite right about giving Notice before issueing the AST. Surely it isn't valid if issuded before the contract is in place. It's worth double checking this point first.
