Hello everyone,

I have had a letting agent manage my property for over a year,however rent collection has been a problem and asked her to serve an eviction notice. she submitted the 8 week notice which expired last Thursday.However she has returned the keys to the house which was in her possession and closed all files relating to the management of the house,which leaves me with tenants who still live in my house but wont pay the rent. Is the letting agent not responsible anymore for submission of court orders or any other action to force through the eviction or do I do all this myself now? Its almost as if she has washed her hands off the problem . any advice please or who can I turn to ?Thank you

Is you agent a member of any professional body like ARLA or NALS, if so get in touch with them

Thank you for your reply,much appreciated. I have contacted alot of professional bodies,like the ones you have mentioned,but she is not a member of any of them.I believe she is a franchisee and the head office is in London,but cant locate any contact details.so.it looks like,I will have to issue court proceedings myself.Thank you for your help sir.

Sounds like you need to read the original contract you signed with the agent and if she was responsible then she's responsible even if she's handed the keys back. However she may want to charge you a lot of admin fees to handle this for you. If she is a franchisee then the registered address of the company should be on the paperwork and I'd still contact them and raise merry hell.

You make me feel better. I have not used an agent for many years, doing everything myself. People laugh at me for apparently giving myself extra work, but your experience proves that I was right to do it myself. If your tenant is more than 2 months in arrears, which seems to be the case, you can go to PCOL (Possession Claim On Line) and get a possession order for £100. If your tenant still refuses to leave, the court bailiff will do an eviction for a further £95. It all takes about two months, but you should get your property back, probably in a mess. Depending on the area your property is in, the type of people you are having to deal with, etc, you will probably be well advised to board up any accessible windows on eviction day, so ask around for a joiner who can do basic locksmithing (which most of them can). The bailiff will advise you in more detail, based on his experience in the area. Good Luck! Eric.
