The Department of Levelling Up, Housing and Communities has given notice that a revamped How To Rent guide is set to be unveiled early next month. This crucial document, which plays a pivotal role in guiding both landlords and tenants, is poised to receive its second update of the year, with the release date tentatively scheduled for October 2, 2023.
The forthcoming edition of the How To Rent guide will not only serve as an informational resource but will also incorporate vital information about the contentious Housing Loss Prevention Advice Service (HLPAS). This newly introduced service is poised to replace the Housing Possession Court Duty Schemes and is designed to provide legal counsel and assistance to tenants who find themselves at risk of losing their homes.
One of the most crucial aspects of this impending change is the obligation it imposes on private landlords. Landlords will be required to furnish their tenants with the most recent version of the How To Rent guide at the commencement of any new tenancy. Furthermore, they must ensure that tenants are provided with an updated guide in the event of any revisions to its contents. Failure to comply with this stipulation could result in the loss of their right to repossess properties through Section 21.
The Housing Loss Prevention Advice Service (HLPAS) is a groundbreaking initiative that will offer free early legal advice to individuals facing the prospect of eviction and home loss. This service will encompass a wide range of issues, including housing, debt, and welfare benefits. Notably, it includes ‘In Court Duty’ assistance, providing on-the-day emergency advice and advocacy for those confronting possession proceedings.
Under the ambit of the HLPAS, the Legal Aid Agency will extend its court duty scheme work to encompass early legal advice concerning housing, welfare benefits, and debt. Importantly, this assistance will be non-means and non-merits tested, ensuring that individuals receive the support they need, irrespective of their financial circumstances.
In an official statement, the government underscored the significance of the HLPAS, stating, “The service enables anyone at risk of losing their home or facing possession proceedings to get free legal advice and representation in court, regardless of their financial circumstances.”
Landlords and tenants alike should mark October 2, 2023, on their calendars, as this is the date when the new versions of the How to Rent guide will become available on the official government website, gov.uk. With these imminent changes, both renters and property owners will need to stay informed and ensure they are in compliance with the evolving regulations in the rental sector.
