Any regulated product or service is subject to the separate documentation, eligibility requirements, policy wording, advice, disclosures and contractual terms provided in connection with that product or service.

Nothing in this Disclaimer excludes, limits or replaces any regulatory duty that applies to NetRent, its principal firm or an authorised service provider when carrying out regulated activity.

The Property for Sale section of the Website provides a property advertising and enquiry-forwarding facility for landlords, property owners, estate agents, letting agents and other authorised advertisers.

5.1 Advertiser responsibility

All property descriptions, photographs, videos, floor plans, measurements, asking prices, rental figures, yields, service charges, tenancy details, occupancy information and other listing content are supplied by or on behalf of the relevant property advertiser.

The property advertiser is solely responsible for ensuring that all information and materials it supplies are accurate, complete, current, lawful and not misleading.

The advertiser is also solely responsible for ensuring that:

• it owns the property or has the owner’s authority to advertise it;
• it has the right to use and publish all photographs, plans and other materials;
• all legally required material information has been disclosed;
• personal information concerning tenants, occupiers and other people is used lawfully;
• the listing is updated when circumstances change; and
• the property is withdrawn promptly when it is no longer available.

5.2 No independent verification by NetRent

NetRent does not normally visit, inspect, survey or value an advertised property.

Unless expressly stated otherwise, NetRent does not independently verify:

• the identity or authority of the advertiser;
• ownership or title;
• tenure or lease terms;
• property boundaries;
• planning status;
• building-regulation compliance;
• property condition;
• measurements;
• structural information;
• licensing requirements;
• safety certificates;
• energy-performance information;
• mortgage or insurance restrictions;
• tenancy status or tenancy documentation;
• rent received or rent arrears;
• service charges or other expenditure;
• stated or projected yields;
• vacant-possession claims;
• availability; or
• suitability for letting or investment.

NetRent may carry out limited administrative, technical, security, fraud-prevention or moderation checks. Any such check does not amount to independent verification, professional due diligence, approval or endorsement and does not transfer responsibility for the listing from the advertiser to NetRent.

Publication of a listing does not constitute a representation, warranty, approval or recommendation by NetRent.

5.3 NetRent is not a party to the transaction

In providing the Property for Sale facility, NetRent does not:

• act for the advertiser or prospective purchaser;
• act as the estate agent for either party;
• arrange or conduct viewings;
• communicate or negotiate offers;
• advise either party on the proposed transaction;
• verify evidence of funds;
• handle deposits, reservation fees or purchase money;
• prepare contracts or conveyancing documents;
• guarantee a sale; or
• become a party to any communication, offer, negotiation, agreement or property transaction.

A property listing is an invitation to make further enquiries. It is not an offer made by NetRent and does not form part of a contract with NetRent.

5.4 Purchaser responsibility

Prospective purchasers must undertake their own investigations and independently verify all information before:

• travelling to view a property;
• incurring professional or other costs;
• making an offer;
• paying any money;
• entering into an agreement; or
• completing a purchase.

Prospective purchasers should obtain appropriate independent legal, conveyancing, surveying, valuation, tax, financial, mortgage and other professional advice.

A property described as rented, recently rented, tenanted, buy-to-let, an investment property or suitable for letting is not guaranteed by NetRent to be lawfully or practically suitable for letting.

Suitability may depend upon matters including planning restrictions, lease restrictions, licensing, property condition, safety requirements, mortgage terms, insurance requirements, local authority rules and the status of any tenancy.

Every listing and enquiry is also subject to the separate Property Listings Disclaimer, Property Advertiser Terms and relevant privacy information.

Property enquiries are sent directly to the email address supplied by the relevant property advertiser. A copy may also be received by NetRent for the administration and support of the enquiry service, as explained in the NetRent Privacy Policy.

The property advertiser is responsible for responding to the enquiry and for all subsequent communications.

NetRent does not guarantee:

• that an advertiser will respond;
• the speed or quality of a response;
• that an advertiser or enquirer is genuine;
• that contact information is correct;
• that an advertiser has authority to sell;
• that an enquirer has sufficient funds;
• that a viewing, negotiation or sale will proceed; or
• that any proposed transaction will complete.

Communications and transactions between advertisers and enquirers take place at their own risk.

Before sending money or providing confidential information, each party should independently verify:

• the identity of the other party;
• the authority of any agent or representative;
• the authenticity of payment instructions; and
• the bank details of the intended recipient.

NetRent does not receive or hold deposits, reservation payments or purchase money through the Property for Sale service. No person should send transaction funds to NetRent unless NetRent has expressly requested payment for a separate, identified service through an authorised payment method.

The Website may contain material supplied by:

• property advertisers;
• service providers;
• insurers;
• mortgage or financial-services providers;
• government bodies;
• professional organisations;
• journalists;
• guest contributors; and
• other third parties.

Third-party content represents the information or views of the person who supplied it. It does not necessarily represent the views of NetRent.

NetRent is not responsible for an error, omission, unlawful statement, infringement or misrepresentation contained in material supplied by another person, except to the extent that responsibility cannot lawfully be excluded or where NetRent becomes legally responsible through its own conduct.

NetRent may review, edit, suspend or remove third-party content where it reasonably considers this appropriate. However, NetRent is not obliged to approve or independently verify every item before publication or to monitor every item continuously.

10.1 Business users

Where you use the Website wholly or mainly for purposes connected with your trade, business, profession or property letting activity, NetRent will not, to the fullest extent permitted by law, be liable for:

• loss of contracts;

Where NetRent has entered into a separate contract with a business user, NetRent’s liability in connection with that service will be governed by the terms of that contract.

10.2 Consumers

Nothing in this Disclaimer affects a consumer’s statutory rights.

Where NetRent is legally responsible to a consumer, NetRent will be responsible for loss or damage that is a reasonably foreseeable result of NetRent’s breach or failure to exercise reasonable care and skill.

NetRent is not responsible to a consumer for business losses arising from use of the Website for trade, business, professional or property-investment purposes.

NetRent’s collection and use of personal information is governed by the NetRent Privacy Policy.

The use of cookies and similar technologies is explained in the NetRent Cookie Policy and through the Website’s cookie-preference facility.
