NetRent Website Terms and Conditions

These Terms and Conditions govern your access to and use of:

  • the NetRent website at www.netrent.co.uk;
  • pages, forms and facilities operated through that website;
  • registered NetRent website accounts;
  • NetRent newsletters and general information services;
  • the NetRent Property for Sale facility; and
  • any other NetRent online service that links to these Terms.

In these Terms:

  • “NetRent”, “we”, “us” and “our” mean NetRent Limited;
  • “Website” means www.netrent.co.uk and the NetRent pages and online facilities that link to these Terms;
  • “User”, “you” and “your” mean anyone who visits or uses the Website;
  • “Business User” means anyone using the Website wholly or mainly for purposes connected with a trade, business, profession or property letting or investment activity;
  • “Consumer” means an individual acting wholly or mainly outside their trade, business, profession or property letting or investment activity;
  • “Content” means articles, news, text, photographs, graphics, videos, property listings, documents, data and other material made available through the Website; and
  • “Service” means any facility, introduction, account, form, listing or other service made available through the Website.

Please read these Terms before using the Website.

By using the Website, submitting a form, creating an account or requesting a Service, you agree to comply with these Terms.

Where a facility requires you to tick an acceptance box, you must do so before using that facility. If you do not agree to these Terms, you should not use the Website.

These Terms should be read alongside NetRent’s:

  • Privacy Policy;
  • Cookie Policy;
  • Website Disclaimer;
  • Complaints Procedure;
  • Property Advertiser Terms;
  • Property Listings Disclaimer; and
  • any additional terms, notices or regulatory disclosures presented in connection with a particular Service.

The Privacy Policy explains how NetRent uses personal information. Accepting these Terms does not constitute consent to marketing or to the use of non-essential cookies.

Where specific terms apply to a particular Service, those specific terms will take priority over these general Website Terms in relation to that Service.

In particular:

  • Property advertisers must accept the Property Advertiser Terms;
  • Property for Sale listings and enquiries are subject to the Property Listings Disclaimer;
  • insurance products are subject to the terms, policy wording and regulatory disclosures of the relevant insurer and insurance intermediary;
  • mortgage and finance services are subject to the terms and regulatory disclosures of the identified authorised adviser or provider; and
  • separately purchased services may be subject to their own order, payment, cancellation and service terms.

NetRent may carry out only the regulated activities permitted under its appointment.

NetRent’s FCA status does not mean that every activity or item of Content on the Website is regulated by the Financial Conduct Authority. General news, editorial material, landlord information and the Property for Sale advertising facility are not regulated financial services.

Mortgage and finance enquiries may be introduced to a separately authorised mortgage or finance adviser identified on the relevant page, form or communication.

You may browse publicly available Website Content without creating an account.

You must be at least 18 years old to:

  • register for a Website account;
  • submit a property advertisement;
  • make a formal product or service enquiry;
  • enter into a contract through the Website; or
  • act on behalf of a business or property owner.

If you use the Website on behalf of a company, partnership, landlord, property owner, client or other organisation, you confirm that:

  • you have authority to act for that person or organisation;
  • you have authority to accept any applicable terms on its behalf; and
  • all information you provide about your authority is accurate.

The Website is principally intended for people and organisations located in the United Kingdom or dealing with property or services in the United Kingdom.

Anyone accessing the Website from outside the United Kingdom is responsible for complying with the laws applying in their own location.

NetRent may update these Terms where reasonably necessary to reflect:

  • changes to the Website or Services;
  • changes in NetRent’s business or regulatory arrangements;
  • legal or regulatory developments;
  • security requirements;
  • the introduction of a new facility; or
  • clarification or improvement of the wording.

The latest version will be published on the Website with an effective date and version number.

Changes will normally apply to use of the Website after the updated Terms take effect.

Where a material change affects an existing registered account or ongoing Service, NetRent will take reasonable steps to notify the affected User and may require acceptance of the updated terms before continued use.

A change will not retrospectively remove rights or create liability for conduct that occurred before the change took effect.

Access to the general Website is provided free of charge.

NetRent does not guarantee that:

  • the Website will always be available;
  • access will be uninterrupted;
  • every page or function will operate without error;
  • the Website will be compatible with every browser, device or system;
  • all Content will remain available indefinitely; or
  • an email or form submission will always be delivered successfully.

NetRent may suspend, restrict or withdraw access to all or part of the Website where reasonably necessary for:

  • maintenance;
  • repair;
  • security;
  • technical changes;
  • system upgrades;
  • legal or regulatory reasons;
  • investigation of misuse;
  • protection of Users or third parties; or
  • circumstances outside NetRent’s reasonable control.

Where reasonably practicable, NetRent will seek to minimise disruption.

You are responsible for:

  • arranging your own internet and device access;
  • maintaining appropriate software and security;
  • ensuring that anyone who accesses the Website through your system is aware of these Terms; and
  • keeping your own copies of information or documents that you may need.

You should not rely on the Website as the sole location in which important records or documents are stored.

Where NetRent provides an account facility, you must:

  • provide accurate and current information;
  • use your own identity or authorised business identity;
  • keep your email address and contact details current;
  • keep login credentials confidential;
  • use a strong and secure password;
  • not allow an unauthorised person to use your account;
  • not create an account for a fraudulent or misleading purpose; and
  • notify NetRent promptly if you suspect unauthorised access.

You are responsible for activity carried out through your account where that activity results from your failure to protect your login credentials.

NetRent may require you to:

  • verify your email address;
  • reset your password;
  • provide evidence of identity or authority;
  • confirm that your account information remains correct; or
  • accept updated terms applying to an account facility.

NetRent may suspend or disable an account if it reasonably believes that:

  • the account information is false or misleading;
  • the account has been compromised;
  • the account is being misused;
  • the User has breached these Terms;
  • the account creates a security, fraud, legal or regulatory risk; or
  • suspension is necessary to protect NetRent, another User or a third party.

You may use the Website only for lawful purposes.

You must not:

  • use the Website fraudulently or unlawfully;
  • impersonate another person or organisation;
  • misrepresent your identity, authority or intentions;
  • submit false, inaccurate or misleading information;
  • upload unlawful, defamatory, discriminatory, threatening, abusive or offensive material;
  • infringe copyright, trade mark, privacy, confidentiality or other rights;
  • obtain or attempt to obtain unauthorised access to an account, server, database or system;
  • introduce viruses, malware, ransomware, spyware or harmful code;
  • interfere with the operation or security of the Website;
  • overload the Website or place an unreasonable burden on its systems;
  • attempt to bypass access, security or moderation controls;
  • use a bot, crawler, scraper or automated tool without NetRent’s written permission;
  • copy or systematically extract Website Content or property listing data;
  • use Website contact details to send spam or unauthorised marketing;
  • harvest or compile personal information about other Users;
  • use property enquiry information for an unrelated purpose;
  • use the Website to facilitate fraud, money laundering or other criminal conduct;
  • falsely state or imply that NetRent endorses you, your business or your property;
  • reproduce or commercially exploit the Website without permission; or
  • encourage another person to do any of these things.

Property listings must be submitted manually using the method provided by NetRent. Automated feeds, portal feeds, bulk uploads, scripts and unauthorised integrations are not permitted unless NetRent agrees otherwise in writing.

NetRent may report suspected criminal activity, fraud, cyberattacks or unlawful conduct to the relevant authorities and may preserve or disclose relevant information where legally permitted or required.

You are responsible for information and material you submit through the Website.

You confirm that information you provide is:

  • accurate;
  • complete where required;
  • current;
  • lawful;
  • not misleading;
  • relevant to the purpose for which it is supplied; and
  • provided with all necessary authority and permissions.

You must not submit unnecessary:

  • bank details;
  • payment-card information;
  • identity documents;
  • passwords;
  • medical information;
  • criminal-record information;
  • information about a tenant’s personal circumstances; or
  • other sensitive or confidential information

through a general contact form, Property for Sale enquiry or ordinary email.

Material intended for publication

Where you submit Content for publication, including property photographs, descriptions, plans or testimonials, you confirm that:

  • you own the Content or have permission to use it;
  • publication will not infringe another person’s rights;
  • the Content is not unlawful or misleading;
  • any people shown or identified have been dealt with lawfully; and
  • you have obtained all necessary licences, permissions and consents.

You retain any intellectual-property rights you own.

You grant NetRent a non-exclusive, royalty-free licence to store, reproduce, format, resize, display and distribute the submitted Content only to the extent reasonably required to:

  • operate the relevant Service;
  • publish the Content as requested;
  • promote the relevant property or Service;
  • maintain security and backups; and
  • deal with complaints or legal requirements.

More detailed licence provisions applying to property listings are contained in the Property Advertiser Terms.

Private submissions

A message or enquiry not intended for publication will not become public merely because it is sent through the Website. NetRent will use such information as explained in the Privacy Policy.

User-supplied Content must not:

  • be false or deliberately misleading;
  • conceal material information;
  • infringe intellectual-property rights;
  • misuse personal information;
  • identify a tenant or occupier unnecessarily;
  • be defamatory;
  • contain unlawful discrimination;
  • encourage violence or criminal activity;
  • contain malicious code;
  • promote fraud or financial crime;
  • misrepresent a property, business or service; or
  • otherwise breach applicable law.

NetRent may review, format, restrict, suspend or remove User-supplied Content where it reasonably considers that:

  • these Terms may have been breached;
  • the Content may be inaccurate, misleading or unlawful;
  • another person’s rights may be affected;
  • a complaint requires investigation;
  • there may be a security or fraud risk;
  • the User has not provided requested evidence; or
  • removal is otherwise reasonably necessary.

NetRent’s review or publication of Content does not amount to independent verification, approval or endorsement.

NetRent is not required to monitor every item continuously.

Unless otherwise stated, the Website and Content created by NetRent are owned by or licensed to NetRent and are protected by copyright, trade mark and other intellectual-property laws.

You may:

  • view Website pages;
  • print or download a reasonable number of pages for your own personal or internal business reference;
  • share links to publicly available Website pages;
  • quote short extracts with appropriate acknowledgement; and
  • use Website Content where NetRent has expressly granted permission.

You must not, without prior written permission:

  • republish a complete article or substantial part of it;
  • copy Website Content onto another website;
  • sell, license or commercially exploit Website Content;
  • remove copyright, trade mark or ownership notices;
  • create a database from Website or property listing Content;
  • use Content to train, develop or supply a commercial artificial-intelligence or data product;
  • frame or embed the Website within another website;
  • reproduce NetRent branding in a misleading manner; or
  • imply an association with or endorsement by NetRent.

“NetRent”, the NetRent logo and related branding may not be used without written permission.

Third-party names, logos and materials remain the property of their respective owners.

You may link to publicly available Website pages provided that the link:

  • is lawful and fair;
  • does not damage NetRent’s reputation;
  • does not suggest an association, approval or endorsement that does not exist;
  • does not display the Website within a frame;
  • does not bypass security or access restrictions; and
  • is not placed on a website containing unlawful or seriously inappropriate material.

NetRent may withdraw permission to link where there is a reasonable legal, reputational, security or operational reason.

You should link to the relevant NetRent page rather than copy its Content.

Website articles, news, guides, opinions and commentary are provided for general information.

They do not constitute:

  • legal advice;
  • tax or accounting advice;
  • financial or investment advice;
  • mortgage or credit advice;
  • insurance advice or a personal recommendation;
  • surveying or valuation advice;
  • planning or building-regulation advice; or
  • advice concerning a particular property, tenancy, transaction or person.

NetRent does not provide legal advice.

Laws, regulations, official guidance, market conditions, insurance requirements and lending criteria can change. Content may therefore become out of date.

You should obtain appropriate professional advice before acting, deciding not to act, entering into a transaction or incurring significant costs.

Further provisions concerning accuracy, reliance and professional advice appear in the Website Disclaimer.

Submitting a general enquiry, callback request or information form does not by itself create a contract for a product or service.

Unless a page expressly states otherwise, a form submission is a request for:

  • information;
  • contact;
  • a quotation;
  • an introduction; or
  • further discussion.

A contract will arise only when the relevant provider accepts the request in accordance with its applicable terms.

A quotation is not binding unless it is expressly confirmed as such and remains subject to any stated conditions, expiry date, eligibility requirements and underwriting or property information.

Where the Website displays a price:

  • a “from” price is indicative;
  • the relevant page or quotation should explain what is included;
  • additional work or circumstances may affect the final price;
  • the price must be confirmed before a binding order is placed; and
  • no additional charge will be imposed without the customer’s agreement.

Where a separate provider supplies the product or service, the contract will normally be between you and that provider. The provider’s terms, privacy notice, cancellation rights and complaints procedure will apply.

NetRent may receive a fee or commission following an introduction or completed transaction. Any more specific disclosure required by law or regulation will be provided in connection with the relevant service.

General Website information concerning insurance, mortgages or finance is not a personal recommendation.

Insurance

Insurance services may be provided through NetRent’s arrangements with Clear Insurance Management Limited and relevant insurers.

Insurance is subject to:

  • eligibility and underwriting;
  • disclosure of material information;
  • insurer acceptance;
  • the applicable policy wording;
  • limits, exclusions, excesses and conditions;
  • premium payment; and
  • the regulatory and contractual documents supplied for the insurance service.

Nothing on the general Website guarantees that a particular risk will be accepted, that a particular premium will apply or that a policy will respond to a particular claim.

Mortgages and finance

NetRent may introduce mortgage and finance enquiries to an appropriately authorised adviser or provider.

Any regulated mortgage or finance advice is provided by the identified authorised firm, not by general Website Content.

Mortgage and finance products are subject to:

  • status;
  • affordability;
  • valuation;
  • lender criteria;
  • underwriting;
  • credit assessment;
  • product availability; and
  • the relevant provider’s terms and regulatory disclosures.

Submitting an enquiry does not guarantee approval or the availability of a particular rate or product.

16.1 Nature of the Service

The Property for Sale Service allows landlords, property owners and authorised agents to advertise property that:

  • is currently rented;
  • has recently been rented;
  • is intended for letting; or
  • may be suitable for use as rental property.

The Service is provided free of charge to property advertisers and enquirers.

NetRent does not charge:

  • a property listing fee;
  • an enquiry fee;
  • a success fee;
  • a commission on the property sale; or
  • a percentage of the sale price.

NetRent will not impose a charge retrospectively or without first clearly informing the affected User and obtaining any agreement legally required.

16.2 Advertiser obligations

Anyone submitting a property must accept the separate Property Advertiser Terms.

The advertiser is solely responsible for:

  • having authority to advertise the property;
  • the accuracy and legality of the listing;
  • photographs, plans and other materials;
  • material property information;
  • tenancy and rental information;
  • keeping the listing current;
  • responding to enquiries;
  • complying with data-protection requirements; and
  • all communications and transactions resulting from the listing.

Where there is any conflict between these general Terms and the Property Advertiser Terms concerning a property listing, the Property Advertiser Terms will take priority.

16.3 NetRent’s role

NetRent provides a property advertising and enquiry-forwarding facility.

NetRent does not ordinarily:

  • inspect, survey or value the property;
  • verify ownership or title;
  • verify the advertiser’s authority;
  • verify tenancy, rent or yield information;
  • arrange or conduct viewings;
  • communicate or negotiate offers;
  • hold deposits or purchase money;
  • conduct conveyancing;
  • advise either party about a transaction;
  • guarantee vacant possession;
  • guarantee a sale; or
  • become a party to the resulting transaction.

Publication does not constitute approval, verification, endorsement or recommendation by NetRent.

16.4 Property enquiries

An enquirer will normally be required to provide:

  • their name;
  • email address;
  • telephone number; and
  • enquiry message.

The enquiry is sent to the email address provided by the property advertiser. A copy is also received by NetRent for the administration and support of the enquiry service, as explained in the Privacy Policy.

NetRent may send a service email or make a service telephone call solely to:

  • acknowledge the enquiry;
  • confirm that it was sent;
  • thank the enquirer for using the Service;
  • provide NetRent contact details; or
  • assist with a delay, delivery problem or complaint.

This service contact will not, by itself, subscribe the enquirer to marketing or result in their information being passed to an insurance or mortgage provider.

16.5 Purchaser responsibility

Prospective purchasers must:

  • make their own enquiries;
  • verify the advertiser’s identity and authority;
  • verify property and tenancy information;
  • obtain appropriate searches and professional advice;
  • verify payment instructions independently;
  • avoid sending money without proper checks; and
  • satisfy themselves that the property is suitable for their intended purpose.

The separate Property Listings Disclaimer applies to all listings and property enquiries.

A subscription to a NetRent newsletter or marketing communication is optional.

Where legally required, newsletter or marketing consent will:

  • be requested separately;
  • not be selected in advance;
  • identify the type of communication;
  • provide a means of withdrawing consent; and
  • not be a condition of using an unrelated Service.

You may unsubscribe from marketing emails using the unsubscribe option provided or by contacting support@netrent.co.uk.

Unsubscribing from marketing does not prevent NetRent from sending necessary:

  • account messages;
  • security notices;
  • property enquiry acknowledgements;
  • service updates;
  • complaint correspondence; or
  • communications concerning an existing request or transaction.

NetRent does not guarantee that every newsletter or email will be successfully delivered, as delivery may be affected by email providers, spam filters, incorrect addresses or technical issues.

The Website may contain links to websites, platforms, documents or services operated by third parties.

A link does not necessarily mean that NetRent:

  • controls the third party;
  • has verified all its Content;
  • endorses every service it offers;
  • guarantees its availability or security; or
  • accepts responsibility for its privacy, cookie or contractual practices.

You should review the third party’s:

  • terms and conditions;
  • privacy notice;
  • cookie information;
  • regulatory disclosures; and
  • product documentation

before using its website or providing information.

NetRent is not responsible for loss caused solely by a third-party website or service that NetRent does not control, except where liability arises from NetRent’s own breach of a legal duty.

NetRent processes personal information in accordance with its Privacy Policy.

The Privacy Policy explains:

  • what information is collected;
  • how and why it is used;
  • the applicable lawful bases;
  • who may receive it;
  • how long it is retained;
  • international processing;
  • security;
  • individual rights; and
  • how to make a data-protection complaint.

The Cookie Policy explains NetRent’s use of cookies and similar technologies.

Non-essential cookies or similar technologies will be used only where the legally required choice or consent has been obtained or a specific statutory exception applies.

Acceptance of these Terms does not:

  • provide consent to receive marketing;
  • override a marketing objection;
  • provide consent to non-essential cookies; or
  • remove any right under data-protection law.

NetRent takes reasonable steps to protect the Website, but cannot guarantee that it will be completely free from:

  • viruses;
  • malware;
  • unauthorised access;
  • cyberattacks;
  • technical faults; or
  • harmful third-party activity.

You are responsible for:

  • protecting your own device and network;
  • using appropriate anti-malware and security software;
  • maintaining secure backups;
  • checking links and attachments;
  • protecting account credentials; and
  • verifying payment or bank information independently.

You must not misuse the Website by knowingly introducing harmful material or attempting unauthorised access.

Suspected security issues should be reported promptly to support@netrent.co.uk.

21.1 Liabilities that are not excluded

Nothing in these Terms excludes or limits:

  • liability for death or personal injury caused by negligence;
  • liability for fraud or fraudulent misrepresentation;
  • liability arising from NetRent’s own unlawful conduct;
  • any liability that cannot lawfully be excluded or limited;
  • any applicable regulatory duty concerning regulated financial-services activity; or
  • a Consumer’s statutory rights.

21.2 General Website use

Subject to clause 21.1, NetRent is not responsible for loss arising solely from:

  • inaccurate or unlawful information supplied by an advertiser or third party;
  • a User’s failure to undertake reasonable checks;
  • reliance on general Content as professional advice;
  • temporary Website unavailability;
  • an event outside NetRent’s reasonable control;
  • a third-party website;
  • a User’s own unlawful conduct;
  • failure to protect passwords or devices;
  • communication or transaction between Users; or
  • the legal, physical, financial or tenancy status of an advertised property.

This does not exclude responsibility to the extent that loss was directly caused by NetRent’s own breach of a legal duty.

21.3 Consumers

Where you are a Consumer, NetRent is responsible for loss or damage that is a reasonably foreseeable result of NetRent’s breach of these Terms or failure to exercise reasonable care and skill.

NetRent is not responsible to a Consumer for:

  • loss that was not reasonably foreseeable;
  • loss caused by inaccurate information supplied by another User;
  • loss caused by the Consumer’s own failure to take reasonable care; or
  • business loss arising from activity undertaken for commercial, professional, letting or investment purposes.

Nothing in these Terms affects any statutory remedy available to a Consumer.

21.4 Business Users

Where you are a Business User, then, subject to clause 21.1 and to the fullest extent permitted by law, NetRent will not be liable for:

  • loss of profit;
  • loss of rent or rental income;
  • loss of revenue;
  • loss of business;
  • loss of contracts;
  • loss of opportunity;
  • loss of anticipated savings;
  • loss of goodwill or reputation;
  • loss or corruption of data not caused by NetRent’s breach;
  • a failed or delayed property transaction; or
  • indirect or consequential loss.

Subject to clause 21.1, NetRent’s total aggregate liability to a Business User arising solely from general use of the free Website facilities will not exceed £100.

This £100 limit does not apply where:

  • a different limit is contained in applicable service-specific terms;
  • the liability concerns regulated financial-services activity;
  • liability arises under data-protection law to the extent it cannot lawfully be limited; or
  • liability otherwise cannot lawfully be limited.

A separate contract for a paid or regulated Service may contain different liability provisions, which will apply to that Service.

This clause applies only to Business Users.

A Business User will compensate NetRent for direct losses, liabilities, damages and reasonable professional costs properly incurred by NetRent to the extent caused by:

  • the Business User’s material breach of these Terms;
  • false or misleading information supplied by the Business User;
  • unlawful Content supplied by the Business User;
  • infringement of another person’s intellectual-property, privacy or confidentiality rights;
  • unauthorised use of personal information obtained through the Website;
  • fraud, dishonesty or deliberate misuse by the Business User;
  • unauthorised access caused by the Business User; or
  • a third-party claim arising directly from that breach or conduct.

The Business User will not be required to compensate NetRent to the extent that the relevant loss was caused by NetRent’s:

  • negligence;
  • fraud;
  • wilful misconduct;
  • material breach of these Terms; or
  • unlawful conduct.

NetRent will:

  • take reasonable steps to reduce recoverable loss;
  • not recover the same loss twice;
  • give reasonable information about a claim;
  • allow reasonable participation in the defence where appropriate; and
  • not agree an unreasonable financial settlement for which reimbursement is sought.

Property advertisers are subject to the more detailed compensation provisions contained in the Property Advertiser Terms.

You may stop using the Website at any time.

Where an account facility is available, you may request closure subject to any records NetRent must retain for legal, regulatory, security or complaint-handling purposes.

NetRent may suspend or terminate access where it reasonably believes that:

  • these Terms have been breached;
  • an account or Service is being misused;
  • information supplied is false or misleading;
  • there is suspected fraud or unlawful activity;
  • another person’s rights are at risk;
  • there is a security threat;
  • the User has failed to cooperate with a reasonable investigation;
  • suspension is required by law or a regulator; or
  • continued access creates a material risk to NetRent, Users or third parties.

NetRent may act immediately where the risk is urgent.

Where practicable and appropriate, NetRent may give the User an opportunity to provide information or correct a breach.

Termination does not affect rights and obligations that arose before termination.

Provisions concerning intellectual property, data protection, responsibility, compensation, liability, complaints and governing law continue where their nature requires them to do so.

General complaints about NetRent or the Website should be made under the NetRent Complaints Procedure.

A complaint about a property listing should identify:

  • the relevant listing or page;
  • the nature of the concern;
  • the information believed to be inaccurate or unlawful;
  • the complainant’s contact details; and
  • any supporting evidence reasonably available.

NetRent may:

  • ask for further information;
  • contact the person who supplied the Content;
  • temporarily suspend Content;
  • preserve relevant records;
  • refer the matter to a service provider, regulator or authority;
  • remove or correct Content where appropriate; or
  • decide that no action is required.

A decision to investigate, suspend, retain or remove Content does not amount to an admission of liability.

Insurance complaints may be handled under the applicable regulated complaints procedure and may be referred to Clear Insurance Management Limited.

Mortgage or finance complaints concerning advice supplied by a separate authorised provider should normally be directed to that provider under its complaints procedure.

Data-protection complaints are handled as explained in the Privacy Policy and Complaints Procedure.

NetRent will not be responsible for delay or failure caused by an event outside its reasonable control, including:

  • internet or telecommunications failure;
  • hosting or email-provider failure;
  • cyberattack;
  • fire, flood or severe weather;
  • utility failure;
  • industrial action;
  • civil disturbance;
  • government restriction;
  • epidemic or public emergency; or
  • failure of an essential third-party system.

This clause does not remove any right or responsibility that cannot lawfully be excluded.

26.1 No partnership or agency

Nothing in these Terms creates a partnership, joint venture, employment relationship or general agency relationship between NetRent and a User.

A property advertiser is not NetRent’s agent, and NetRent is not the property advertiser’s agent.

26.2 Assignment

You may not transfer an account or your rights under these Terms without NetRent’s written permission.

NetRent may transfer its rights and obligations to a company acquiring or operating the relevant part of its business, provided that this does not materially reduce a Consumer’s legal protections.

26.3 No waiver

If NetRent does not immediately enforce a right, that does not mean the right has been waived.

26.4 Severability

If any provision is held to be invalid or unenforceable, it will be removed or restricted only to the minimum extent necessary. The remaining provisions will continue to apply.

26.5 Third-party rights

Unless expressly stated otherwise, no person who is not a party to these Terms may enforce them under the Contracts (Rights of Third Parties) Act 1999.

26.6 Entire agreement for Business Users

For Business Users, these Terms and any applicable service-specific terms constitute the agreement concerning use of the relevant Website facility.

A Business User confirms that it has not relied on a statement not included in the applicable agreement.

Nothing in this clause excludes liability for fraud or fraudulent misrepresentation.

26.7 Interpretation

Headings are included for convenience and do not affect interpretation.

Words such as “including” and “includes” are illustrative and do not limit the words preceding them.

These Terms and any non-contractual obligations arising from them are governed by the law of England and Wales.

Business Users

Where you are a Business User, the courts of England and Wales will have exclusive jurisdiction over a dispute concerning the Website or these Terms.

Consumers

Where you are a Consumer:

  • if you live in England or Wales, proceedings may be brought in the courts of England and Wales;
  • if you live in Scotland, proceedings may normally be brought in Scotland or England and Wales; and
  • if you live in Northern Ireland, proceedings may normally be brought in Northern Ireland or England and Wales.

Nothing in this clause deprives a Consumer of mandatory legal protection available in the part of the United Kingdom in which they live.
